The Marchman Act provides for the involuntary or voluntary assessment and stabilization of a person allegedly abusing substances like drugs or alcohol.
A court may grant a Petition for Involuntary Assessment, Stabilization and/or Treatment, if there is a reasonable belief that the individual is substance abuse impaired and the individual:

La corte puede conceder el remedio de evaluacion involuntaria si hay indicios de que la persona tiene un problema de adiccion y el invididuo:
(a) has lost the power of self-control with respect to substance use;and. either;
(a) ha perdido el control del uso de la sustancia y una de las siguientes condiciones estan presentes;
(b) has inflicted or is likely to inflict physical harm on him/herself or others unless admitted; or
(b) se ha causado o podria causarse dano fisico a si mismo o a otras personas de no recluirse, o
(c) the person's judgment is so impaired they are incapable of appreciating the need for care and making a rational decision regarding such care; or
(c) el juicio de la persona esta tan afectado que no puede apreciar la necesidad de tratamiento o le impide tomar una decision racional en cuanta a su necesidad de ayuda; o
(d) the person has refused to seek voluntary care.

A Petition for Involuntary Assessment may be filed when there is good faith reason to believe an individual is substance-abuse impaired and because of that impairment, has lost the power of self-control with respect to substance use. The Petition is filed with the Clerk of Court and must be set for hearing within 10 days. Notice of hearing is provided by mail to the petitioners. The patient is served notice of hearing by the Sheriff. A General Master presides at the hearing. After hearing all relevant testimony, the court may enter an Order for Involuntary Assessment. Unless arrangements have been made for assessment at a private facility, the court order shall direct the Sheriff's Office to take the patient into custody and deliver him/her to a public facility licensed by the Department of Children and Families.
La Peticion judicial se presenta a la corte cuando de buena fe el peticionario piensa que la persona ha perdido totalmente el control en cuanto su uso de sustancias o alcohol, y esto presenta un riesgo para su seguridad o la de otros. La Peticion es presentada a la corte y se celebrara una vista dentro de diez dias. Se le notificara a la persona por correo sobre la vista, y en la misma el juez de considerarlo apropiado, luego de escuchar el testimonio, ordenara la evaluacion involuntaria de la persona que se llevara a cabo en una institucion privada o publica segun los recursos de plan medico del individuo.
A Petition for Involuntary treatment may be filed once the written assessment is reviewed by the court and the recommendation is involuntary treatment.
Si la evaluacion resulta en una recomendacion de tratamiento de rehabilitacion, la familia entonces podra pedir que se recluya involuntariamente a la persona en una facilidad de rehabilitacion.
Notice of hearing is provided by mail to the petitioners and any attorney on record. The patient is once again served notice of hearing by a plain.clothes Deputy Sheriff. A general master presides at the hearing and after taking all relevant testimony, the court may enter an order for involuntary treatment for a period not to exceed 60 days. It may also direct the Sheriff to take the patient into custody and delivery him to the licensed facility.
Se le dara notificacion de vista a la persona y luego de la vista el juez de considerarlo procedente, podra ordenar la reclusion involuntaria por un termino de 60 dias en una institucion de rehabilitacion, y podra ordenar en ciertos casos que la policia lo ponga bajo su custodia para hacerlo cumplir con lo ordenado.
